Contoured, Inc. (“Contoured,” “we,” “us,” or “our”) respects privacy and is committed to being transparent about the information we collect, how we use it, how we protect it, and how it may be disclosed in connection with our website, business communications, proposal requests, client projects, drone operations, reality-capture services, marketing media services, and related business activities.
Contoured provides building measurement, mapping, modeling, documentation, LiDAR scanning, drone and aerial capture, 360° imagery, point cloud, floor plan, CAD/BIM, digital twin, asset documentation, photography, videography, and related reality-capture services. Much of the data Contoured collects in connection with a client project is governed by the written agreement between Contoured and the applicable client. This Privacy Policy describes our general privacy practices and does not replace the terms of any client agreement, confidentiality agreement, data processing agreement, master services agreement, project proposal, purchase order, statement of work, or other written contract.
1. Scope of This Privacy Policy
This Privacy Policy applies to information we collect through our website, website contact forms, proposal request forms, email communications, phone communications, sales and marketing communications, client relationship activities, client projects, drone or unmanned aircraft system operations, ground-based and aerial reality-capture services, photography and videography services, vendor and subcontractor interactions, business partner interactions, and recruiting or job applicant communications, if applicable.
This Privacy Policy does not override any written agreement between Contoured and a client. Where Contoured processes project data on behalf of a client, that data is generally handled under the applicable written agreement with that client. If a client agreement contains terms that are more specific than this Privacy Policy, the client agreement will generally control with respect to the applicable project data.
2. Information We Collect
The information we collect depends on how you interact with Contoured and the type of service being performed.
2A. Information You Provide to Us
We may collect information that you voluntarily provide to us, including name, company name, job title or role, email address, phone number, mailing address, business address, project location, property information, information submitted through website forms, proposal requests, messages, questions, billing information, invoicing information, payment-related information, contract information, purchase order information, statement of work information, project documentation, and resume, employment history, or recruiting information if you apply for a position with us.
We primarily collect this information when you ask to be contacted, request a proposal, submit a website form, communicate with our team, become a client, submit project information, request services, engage us for a project, or otherwise interact with Contoured.
2B. Website, Analytics, and Technical Information
When you visit our website, we may automatically collect limited technical information, including IP address, browser type, device type, operating system, referring website, pages viewed, date and time of visit, general location information derived from IP address, cookie information, form interaction data, website performance data, and other information collected through cookies, scripts, tags, or similar technologies.
Contoured currently uses Google Analytics, Webflow Analytics, HubSpot, and reCAPTCHA. We use these tools to operate our website, understand website performance, evaluate traffic and engagement, manage form submissions, organize client and prospect communications, protect against spam, fraud, or abuse, improve user experience, and support general business operations.
Contoured does not currently use Google, Instagram, LinkedIn, Meta, or similar advertising platforms for targeted behavioral advertising or retargeting. If our advertising or tracking practices materially change in the future, we will update this Privacy Policy as appropriate and provide any legally required choices.
2C. Sales Prospecting and Business Contact Information
Contoured may use professional networking and sales prospecting tools, including LinkedIn and LinkedIn Sales Navigator, to identify and communicate with business contacts who may have an interest in Contoured’s services. The information used for these purposes may include professional or business contact information, such as name, company, job title, work email, work phone number, professional profile information, industry, business location, professional interests, mutual connections, and business relationship history.
We use this information for business-to-business communications, client development, proposal opportunities, relationship management, and general sales outreach. We do not sell this information.
2D. Project, Reality-Capture, Drone, Photo, and Video Data
In connection with client projects, Contoured may collect, generate, process, store, and deliver project-related data, including LiDAR scans, point clouds, 360° imagery, photographs, video, drone or unmanned aircraft system imagery, aerial photography, aerial video, thermal imagery, aerial LiDAR data, ground-based LiDAR data, building measurements, roof and exterior documentation, site imagery, floor plans, CAD files, BIM/Revit files, digital twin data, asset information, equipment information, furniture information, fixture information, building system information, building-component data, location metadata, site metadata, building metadata, project notes, project documentation, and other information necessary to document existing conditions and prepare project deliverables.
Contoured may use drones or unmanned aircraft systems in connection with certain projects. Contoured’s commercial drone operations are conducted by FAA-certificated remote pilots operating under Part 107, using drones registered for Part 107 operations where required, and subject to applicable FAA airspace authorizations, waivers, Remote ID requirements, insurance requirements, and project-specific contract requirements.
Project, reality-capture, drone, photo, and video data may be collected to perform contracted services, including building measurement, mapping, modeling, documentation, asset tracking, area analysis, roof documentation, exterior documentation, site analysis, thermal analysis, digital twin creation, existing-condition verification, construction progress documentation, marketing content creation, leasing content creation, and related project deliverables.
Contoured does not collect project imagery for the purpose of identifying individuals. However, because Contoured performs work inside, outside, above, and around real buildings, facilities, campuses, properties, construction sites, airports, industrial facilities, office buildings, retail properties, multifamily properties, and job sites, project imagery may inadvertently capture people, faces, likenesses, badges, uniforms, workstations, vehicles, license plates, neighboring properties, signage, screens, site activity, tenant spaces, employee areas, visitors, contractors, and other information that could relate to an individual, business, property, or location.
Thermal imagery is used for project-related purposes such as building analysis, roof analysis, site analysis, system analysis, condition documentation, energy-related observations, or other client-authorized project purposes, where applicable. Contoured does not use thermal imagery to identify individuals, diagnose health conditions, monitor individual behavior, or make decisions about individuals.
Where feasible and appropriate, Contoured may coordinate with clients to reduce unnecessary capture of individuals, sensitive information, unrelated areas, or neighboring properties during project work. Project-specific privacy, confidentiality, masking, access, retention, deletion, publication, or other handling requirements should be addressed in the applicable written agreement or project instructions.
2E. Marketing Photography and Videography
Contoured may provide photography, videography, drone footage, 360° imagery, and related visual content for client marketing, leasing, promotional, website, social media, presentation, advertising, and public-relations purposes.
When Contoured captures marketing-related content for a client, the scope, permitted use, publication rights, approvals, and responsibilities for obtaining any necessary permissions, releases, site notices, occupant notices, tenant approvals, employee approvals, or consents should be addressed in the applicable written agreement or project instructions.
Marketing photos and videos may include buildings, interiors, exteriors, amenities, construction progress, tenant spaces, employees, visitors, contractors, vehicles, signage, surrounding site conditions, neighboring areas, and other visual elements that are within or around the project location. Contoured does not use marketing imagery for facial recognition or biometric identification.
Unless otherwise agreed in writing, Contoured may deliver marketing-related content to the client or to parties authorized by the client. The client is generally responsible for determining how client-approved marketing content is published, distributed, displayed, edited, or otherwise used after delivery, subject to the applicable agreement.
2F. AI-Assisted Object Recognition and Asset Tracking
Contoured may use artificial intelligence, machine learning, large language models, computer vision, or similar tools to support project work, including object recognition, asset tracking, classification, documentation, quality control, workflow automation, data extraction, image analysis, project analysis, and preparation of deliverables.
These tools may be used with project data such as LiDAR scans, point clouds, 360° imagery, photographs, drone imagery, video, thermal imagery, CAD files, BIM/Revit files, floor plans, asset documentation, and related project information.
Contoured does not use facial recognition technology or biometric identification tools to identify individuals in project imagery. Contoured’s use of AI is intended to support building documentation, asset recognition, project analysis, quality control, and service delivery, not to identify people.
Where third-party AI tools or software providers are used, Contoured seeks to use those tools in a manner consistent with applicable client agreements, confidentiality obligations, reasonable data-protection practices, and applicable law.
3. How We Use Information
Contoured may use information to respond to inquiries, prepare proposals, prepare estimates, define project scopes, communicate with clients, communicate with prospective clients, communicate with vendors and partners, provide building measurement services, provide mapping services, provide modeling services, provide drone and aerial capture services, provide reality-capture services, provide digital twin services, provide photography and videography services, prepare marketing media deliverables, create project files, review project files, deliver project files, perform quality control, manage projects, manage client relationships, process contracts, process purchase orders, process invoices, process payments, operate our website, analyze website performance, improve our website, manage form submissions, manage business communications through HubSpot or similar tools, protect against spam, fraud, or abuse through reCAPTCHA or similar tools, maintain the security and functionality of our systems, conduct internal business analysis, manage vendors, manage subcontractors, support business-to-business sales prospecting and relationship management, recruit and evaluate job applicants if applicable, comply with legal, contractual, accounting, tax, insurance, and regulatory obligations, enforce agreements, and protect the rights, safety, property, and security of Contoured, our clients, our personnel, and others.
We do not use personal information for purposes that are materially unrelated to the reason it was collected unless we provide appropriate notice or obtain consent where required.
4. How We Disclose Information
Contoured may disclose information in limited circumstances as described below.
4A. Clients
We may disclose project data, deliverables, communications, and related information to the client that engaged Contoured, to the property owner, to the client’s representatives, or to parties authorized by the client, subject to the applicable agreement and project requirements.
4B. Service Providers and Vendors
We may disclose information to service providers, vendors, consultants, subcontractors, and software providers that help us operate our business and provide services, including website hosting providers, Google Analytics, Webflow Analytics, HubSpot, reCAPTCHA, cloud storage providers, IT providers, cybersecurity providers, email and communication tools, accounting providers, billing providers, payment processors, project management tools, reality-capture software providers, CAD software providers, BIM software providers, point cloud software providers, visualization software providers, digital twin software providers, drone software or flight-management providers, AI tools, machine learning tools, object-recognition tools, professional advisors, attorneys, accountants, insurers, and consultants.
These parties are authorized to use information only as needed to provide services to Contoured, support a client project, comply with contractual obligations, or as otherwise permitted by contract or law.
4C. Subcontractors and Project Partners
Where appropriate for a project, Contoured may share project-related information with subcontractors, consultants, drone operators, data processors, technology partners, visualization partners, modeling partners, or other project participants involved in performing or supporting the work. Such sharing is generally governed by the applicable project agreement, confidentiality obligations, and project requirements.
4D. Legal, Safety, and Compliance Purposes
We may disclose information if we believe disclosure is necessary or appropriate to comply with applicable law, respond to legal process, respond to subpoenas, respond to court orders, respond to government requests, enforce agreements, protect Contoured’s rights, protect Contoured’s property, protect Contoured’s safety, protect the rights, property, or safety of clients, personnel, or others, investigate fraud, investigate security incidents, or address misuse of our website, systems, services, or deliverables.
4E. Business Transactions
If Contoured is involved in a merger, acquisition, financing, reorganization, sale of assets, transfer of assets, or similar business transaction, information may be disclosed or transferred as part of that transaction, subject to appropriate confidentiality and legal protections.
5. No Sale of Personal Information
Contoured does not sell personal information.
Contoured does not currently buy, sell, or share personal information of 100,000 or more California residents or households, and Contoured does not derive 50% or more of its annual revenue from selling California personal information.
Contoured does not currently use Google, Instagram, LinkedIn, Meta, or similar advertising platforms for targeted behavioral advertising or retargeting.
If our practices change in a way that requires additional notice, opt-out rights, or updates under applicable privacy laws, we will update this Privacy Policy as appropriate and provide any legally required choices.
6. Cookies and Website Technologies
Our website may use cookies, scripts, tags, pixels, or similar technologies to help the website function, understand website traffic, improve performance, maintain security, evaluate engagement, manage contact forms, and process form submissions.
Contoured currently uses Google Analytics, Webflow Analytics, HubSpot, and reCAPTCHA. These tools may use cookies, scripts, tags, or similar technologies to provide analytics, website functionality, form management, customer relationship management, spam prevention, fraud prevention, and security-related services.
You can adjust your browser settings to refuse or delete cookies. Some website features may not function properly if cookies are disabled.
Contoured does not currently use targeted advertising cookies or retargeting pixels from Google, Instagram, LinkedIn, Meta, or similar advertising platforms. If we begin using such technologies in the future, we will update this Privacy Policy and provide any legally required choices.
7. Data Retention
Contoured retains information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, comply with contractual obligations, support project documentation, maintain business records, resolve disputes, enforce agreements, comply with legal obligations, and protect our rights.
Retention periods vary depending on the type of information and the context in which it is collected. Website inquiry information, proposal information, and business contact information may be retained for business development, client communication, and recordkeeping purposes. Client records, project records, contracts, purchase orders, and project communications may be retained for the duration required by the applicable agreement, project needs, quality-control requirements, insurance requirements, legal requirements, or legitimate business purposes. Building measurement data, LiDAR data, 360° imagery, drone imagery, aerial imagery, thermal imagery, photographs, videos, CAD files, BIM files, point clouds, floor plans, digital twin data, and related project data may be retained in accordance with the applicable client agreement, project requirements, or Contoured’s project-retention practices. Billing records, accounting records, and payment-related records may be retained as required for tax, accounting, audit, and legal purposes. Job applicant information, if collected, may be retained as needed for recruiting, hiring, and employment-law compliance. Backup copies may remain for a limited period as part of ordinary backup, archival, security, and disaster-recovery processes.
Clients with project-specific retention, deletion, masking, access, confidentiality, publication, or other data-handling requirements should address those requirements in the applicable written agreement or project instructions.
8. Security
Contoured uses reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, loss, misuse, disclosure, alteration, or destruction.
These safeguards may include access controls, password protections, limited permissions, secure storage practices, vendor controls, confidentiality obligations, project access limitations, backup practices, and other reasonable security measures appropriate to the nature of the information.
No method of transmission, storage, or electronic processing is completely secure. Contoured cannot guarantee absolute security, but we take reasonable steps to protect information in our custody or control.
9. Client Project Data
Most data collected on site during Contoured projects is collected and processed in connection with a written agreement between Contoured and the applicable client.
As between Contoured and the client, ownership, permitted use, confidentiality, access, delivery, retention, deletion, masking, publication, marketing use, and other obligations related to project data are generally governed by the applicable written agreement.
Where Contoured processes personal information or project data on behalf of a client, Contoured generally does so to provide contracted services to that client and not for unrelated advertising, sale, or data brokerage purposes.
For project-related data controlled by a Contoured client, Contoured may refer privacy-related requests to the applicable client or handle such requests in accordance with the applicable client agreement.
10. Your Choices and Requests
You may contact Contoured to ask questions about this Privacy Policy, request that we update or correct contact information you provided, ask to be removed from marketing communications, request deletion of information where appropriate and legally permissible, or ask questions about project-related privacy concerns.
You may opt out of marketing emails by using the unsubscribe link included in those emails or by contacting us directly. Even if you opt out of marketing communications, we may still send non-marketing communications, such as project communications, service communications, billing communications, legal notices, and administrative messages.
Certain requests may be limited where information is needed to complete a project, comply with a contract, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, protect legal rights, maintain insurance records, preserve project documentation, or fulfill client instructions.
11. California and Other State Privacy Laws
Contoured is based in California and is committed to transparent privacy practices.
Based on Contoured’s current business operations, Contoured does not currently meet the statutory thresholds that would make it a covered business under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. Specifically, Contoured does not have gross annual revenue over $25 million, does not buy, sell, or share personal information of 100,000 or more California residents or households, and does not derive 50% or more of its annual revenue from selling California personal information.
If Contoured’s business operations change in a way that makes additional state privacy-law obligations applicable, Contoured will update this Privacy Policy and provide any required notices or rights.
Even where specific state privacy laws do not apply, Contoured may, in its discretion and where reasonable, respond to privacy-related requests consistent with this Privacy Policy, contractual obligations, and applicable law.
12. Children’s Privacy
Contoured’s website and services are intended for business and professional users. They are not directed to children.
We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete that information.
13. Third-Party Websites and Services
Our website, communications, or deliverables may contain links to third-party websites, platforms, tools, or services. This Privacy Policy does not apply to third-party websites or services that Contoured does not control.
We encourage you to review the privacy policies of any third-party websites, platforms, tools, or services you use.
14. Changes to This Privacy Policy
Contoured may update this Privacy Policy from time to time to reflect changes in our business, services, technology, legal requirements, or privacy practices.
When we update this Privacy Policy, we will revise the “Last Updated” date above. If changes are material, we may provide additional notice where appropriate.
