These Legal Terms and Professional Disclaimers govern access to and use of the website operated by Contoured, Inc., a California corporation. By accessing this website, submitting a form, requesting information, downloading materials, accessing project materials, or otherwise interacting with Contoured through this website, you acknowledge these terms and, where applicable, agree to be bound by them. If you do not agree, you should not use this website. These terms apply to website use and website materials only and do not replace any signed proposal, statement of work, master services agreement, confidentiality agreement, purchase order, client agreement, or other written contract with Contoured. If a signed written agreement conflicts with these terms, the signed written agreement controls for the applicable project or services.
The materials on this website, including text, graphics, photographs, videos, diagrams, floor plan examples, models, case studies, service descriptions, trademarks, logos, and other content, are owned by Contoured or used with permission and are protected by copyright, trademark, and other intellectual property laws. Website materials may be viewed for personal or internal business evaluation purposes only and may not be copied, modified, distributed, reproduced, publicly displayed, commercially exploited, scraped, mirrored, framed, reverse engineered, or otherwise used without Contoured’s written permission.
The materials on this website are provided for general informational and marketing purposes only and are provided “as is” and “as available.” Contoured disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, and reliability. Website descriptions, images, case studies, project examples, square footage references, timelines, accuracy statements, deliverable examples, and results are illustrative only and do not guarantee any particular outcome, timing, measurement result, approval, cost savings, or project result.
Contoured provides reality capture, existing-condition documentation, building measurement, mapping, modeling, LiDAR scanning, 360° imagery, point clouds, floor plans, CAD/BIM deliverables, digital twin materials, area analysis, BOMA area calculations, asset documentation, photography, videography, drone and aerial capture, and related documentation and consulting services as described in the applicable written project scope. Contoured’s standard services are intended to document, measure, depict, analyze, and visualize existing conditions accurately to the best of Contoured’s ability within the agreed scope of work. Contoured does not design buildings, design improvements, engineer building systems, determine structural adequacy, establish property boundaries, prepare stamped construction documents, or provide permit documents as part of its standard services.
Unless expressly stated in a signed written agreement and performed under the responsible charge or responsible control of the appropriate licensed professional, Contoured does not provide architectural design, civil engineering, structural engineering, land surveying, boundary surveying, geodetic surveying, cadastral surveying, landscape architecture, geology, geotechnical engineering, code-compliance review, accessibility-compliance review, life-safety review, permitting services, construction administration, legal advice, lease legal interpretation, title advice, appraisal advice, brokerage advice, or any other service requiring a licensed professional.
Contoured’s services are structured to avoid activities requiring licensure under applicable California professional-practice laws unless those services are expressly performed under the responsible charge or responsible control of an appropriately licensed professional. This limitation includes, without limitation, California Business and Professions Code §§ 6701, 6702, 6703, 6704, 6731, 6731.1, 6737.1, 8726, 8727, 5500, 5500.1, 5536, 5536.1, and 5537. Contoured’s deliverables should not be used to establish, retrace, determine, certify, or opine on property lines, parcel boundaries, easements, rights-of-way, legal descriptions, survey monuments, subdivision boundaries, geodetic control, cadastral boundaries, grading design, drainage design, structural integrity, engineering design, architectural design, code compliance, accessibility compliance, life-safety compliance, or any other matter requiring a licensed land surveyor, licensed civil engineer, licensed architect, licensed structural engineer, licensed geologist, licensed landscape architect, attorney, appraiser, broker, or other licensed professional.
BOMA area measurement is a specialized commercial real estate measurement discipline. There is no state licensing board or governmental licensing body that licenses individuals or firms as “BOMA experts” in the same manner that states license architects, engineers, or land surveyors. A professional license as an architect, engineer, or land surveyor does not, by itself, establish expertise in BOMA floor measurement standards, BOMA interpretation, BOMA area calculations, or commercial real estate area analysis. Contoured’s BOMA expertise is based on participation in the development and co-authorship of BOMA measurement standards, participation on the BOMA Floor Area Standards Committee, measurement of thousands of buildings to BOMA and related standards, interpretation of those standards, training and education regarding those standards, and repeated application of those standards across office, industrial, retail, mixed-use, multi-family, institutional, and other commercial real estate assets.
Area calculations, rentable area calculations, usable area calculations, gross area calculations, BOMA analyses, IPMS analyses, REBNY analyses, ANSI analyses, lease outline drawings, and similar reports depend on the applicable standard, edition, method, interpretation, project scope, assumptions, source materials, field conditions, lease language, client instructions, and condition of the property as of the date of measurement or report. Contoured’s area analyses are not legal opinions, lease interpretations, title opinions, appraisal reports, tax advice, brokerage advice, or guarantees of how any landlord, tenant, buyer, seller, lender, broker, appraiser, court, arbitrator, public agency, or other third party will interpret a lease, measurement standard, building condition, or contractual right.
All floor plans, site documentation, building documentation, area calculations, models, point clouds, CAD files, BIM files, digital twin materials, photographs, videos, drone imagery, thermal imagery, and related deliverables are subject to inherent limitations, including access restrictions, field conditions, occlusions, equipment tolerances, capture conditions, measurement standards, project assumptions, client-provided information, third-party source materials, and changes after the date of capture or report. All dimensions, areas, conditions, elevations, clearances, locations, quantities, and measurements should be reviewed and field verified by the appropriate qualified professionals before use for construction, demolition, fabrication, installation, permitting, structural analysis, MEP coordination, code compliance, accessibility compliance, life-safety decisions, lease negotiations, financing, acquisition, disposition, valuation, or other project-critical reliance.
If any calculation, floor plan, model, area analysis, or other deliverable is based in whole or in part on drawings, CAD files, BIM files, surveys, lease documents, title materials, owner records, consultant files, or other information provided by a client or third party, Contoured does not warrant the accuracy, completeness, authorship, or currentness of those source materials unless expressly stated in a signed written agreement. If any portion of a building, site, tenant space, system, improvement, or area has been altered, renovated, repaired, damaged, demolished, replaced, reconfigured, repurposed, or otherwise changed after the date of capture, measurement, report, or delivery, Contoured makes no warranty that the deliverables continue to reflect current conditions.

To the fullest extent permitted by law, Contoured and its officers, directors, employees, contractors, agents, suppliers, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to use of this website or website materials, including damages for lost profits, lost revenue, lost data, business interruption, loss of goodwill, or other intangible losses, even if Contoured has been advised of the possibility of such damages. Unless otherwise stated in a signed written agreement, Contoured’s liability for any alleged error, omission, inaccuracy, or defect in a project deliverable is limited to the amount paid to Contoured for the specific service or deliverable giving rise to the claim.
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or use of this website must be brought exclusively in the state or federal courts located in Orange County, California, and the user consents to personal jurisdiction and venue in those courts. In any action or proceeding arising out of or relating to these terms, the prevailing party is entitled to recover its reasonable attorneys’ fees and costs, except where prohibited by applicable law.
These terms, together with the Privacy Policy and any other notices posted on this website, constitute the entire agreement between the user and Contoured regarding use of this website. No modification or waiver of these terms is effective unless in writing and signed by an authorized representative of Contoured.
